These terms govern your use of Mimi, made by Loch Partners LLC ("we," "us"). By using Mimi, you agree to these terms and to Apple's Standard End User License Agreement (EULA), which governs your use of the app as licensed software: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. Where these terms and the Standard EULA overlap, both apply; where they conflict on a term specific to Mimi (such as the subscription description below), these terms control.
The Service
Mimi is a Japanese-listening app. It plays short video clips through YouTube's own embedded player and shows a transcript, translation, and word-level tools alongside them. Mimi is provided by Loch Partners LLC and is not affiliated with, endorsed by, or sponsored by Google LLC or YouTube. Videos are played through YouTube's embedded player; Mimi does not host, download, store, or modify any video or audio, and streams every clip live from YouTube. Your use of that playback is also subject to YouTube's Terms of Service: https://www.youtube.com/t/terms.
Subscription (Required Disclosure)
Mimi offers auto-renewing subscriptions ("Mimi Pro"):
- Payment will be charged to your Apple ID account at confirmation of purchase.
- Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
- Your account will be charged for renewal within 24 hours prior to the end of the current period, at the price you agreed to for that plan.
- You can manage your subscription and turn off auto-renewal by going to your Apple ID Account Settings after purchase (Settings > [your name] > Subscriptions on your device).
- Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription, where applicable.
- Mimi currently offers a 7-day free trial on both the monthly and annual plan. If you do not cancel before the trial ends, you will be charged the plan's price and the subscription will continue until cancelled.
- Current prices for each plan are shown on the in-app subscription screen and on this app's App Store product page; both are the source of truth, not this document.
No Accounts, no User Content Sharing
Mimi does not have user accounts. Anything you save (words, phrases, settings) stays on your device and is not visible to us or to any other user.
What You May Not Do
You may not use Mimi to download, extract, redistribute, or republish any video or audio played through it, or attempt to circumvent YouTube's playback restrictions.
Disclaimer and Limitation of Liability
Mimi is provided "as is." We do not guarantee any particular learning outcome. Video content is sourced from third-party YouTube channels; we do not control and are not responsible for that content. To the maximum extent permitted by law, our liability for any claim relating to Mimi is limited to the amount you paid us in the twelve months before the claim.
Governing Law
These terms are governed by the laws of the State of Florida, USA, without regard to conflict of law rules. Any dispute will be brought in the state or federal courts located in Florida, and you consent to their jurisdiction. Nothing in this section limits any consumer rights you have under the mandatory law of the country where you live.
Changes
We may update these terms; continued use after a change means you accept the update.
